Item Open Access التقسيم الإداري ضمن مشروع أوت 2018 المتضمن المشروع التمهيدي لقانون الجماعات الإقليمية الجزائري Administrative Division Within The August 2018 Project, Which Includes The Introductory Draft Of The Algerian Regional Communities Law(Université de M'sila, 2020-06) ملياني, صليحةملخص: تهدف هذه الدراسة إلى البحث في نظام المقاطعات الإدارية التي استحدثها المشرع الجزائري بموجب المرسومين الصادرين سنتي 2015 و2018 على التوالي، وكذا التقسيمات الإدارية الجديدة التي وضعها المشروع التمهيدي لقانون الجماعات الإقليمية الذي سيكون بديلا عن قانوني البلدية والولاية الحاليين، خاصة في ظل عدم وضوح معالم هذا التقسيم و الهدف منه. فما يميز الوحدات الإدارية الجديدة خاصة المستحدثة بالمشروع التمهيدي هو أنه لها طابع مغاير للتقسيمات الإدارية المعهودة، مبررا استحداثها بأنها وجدت للنهوض بالخدمة العمومية في الفضاء المحلي، وضمان تنمية مستمرة للأقاليم، فهل هذا الدافع كافي ؟ . Résumé: Afin de protéger l'indépendance des collectivités locales et leur jouissance par l'exercice du principe constitutionnel de libre administration, les lois contrôlées des collectivités locales dans les systèmes décentralisés marocain et tunisien ont donné un ensemble de pouvoirs et de pouvoirs dans une série de domaines pour jouer son rôle des organes élus dans la réalisation du développement durable conformément aux orientations politiques de l'État central et aux politiques publiques Ministères sectoriels, Cette législation visait à encadrer les relations entre les organes décentralisés et les intérêts centraux en essayant de tracer les limites de la pratique de la principe de la libre gestion des collectivités locales en échange du contrôle des interventions des représentants de l'autorité centrale dans le cadre du contrôle administratif qui a remplacé la surveillance, où celle-ci œuvre pour appliquer la loi et faire en sorte que l'engagement des collectivités locales respecte les lois, législations et textes réglementaires régissant l'exercice de leurs pouvoirs.Item Open Access الرقابة السياسية على دستورية القوانين - المجلس الدستوري الفرنسي نموذجا- Political Control Of The Constitutionality Of Laws - The French Constitutional Council As A Model - Contrôle Politique De La Constitionnallité Des Lois – Le Conseil Constitutionnel Fraiçais Est Un Modèle-(Université de M'sila, 2020-06) حكيم, تبينةإعتمد المؤسس الدستوري الفرنسي طريقة الرقابة السياسية على دستورية القوانين من خلال إنشاء المجلس الدستوري بإعتباره هيئة سياسية مستقلة نظرا لعدم الثقة في السلطة القضائية، وذلك بهدف حماية الحقوق و الحريات الأساسية للأفراد و ضمان إحترام مبدأ سمو الدستور، و تتمحور إشكالية هذه الدراسة حول مدى فعالية الآليات التي يعتمد عليها المجلس الدستوري في ممارسة دوره الرقابي تكريسا لطابعه السياسي؟ و قصد معالجة الموضوع في مختلف جوانبه تم الإعتماد على المنهج الوصفي المناسب لهذه الدراسة بالإضافة إلى المنهج التحليلي في التعامل مع النصوص القانونية، و قد توصلنا إلى أن قصور الرقابة السياسية السابقة التي يمارسها المجلس الدستوري وفق آلية الإخطار كانت الدافع لتفعيل رقابة قضائية لاحقة على دستورية القوانين، من خلال الإعتراف بحق الأفراد في التقاضي أمام المجلس الدستوري بطريقة غير مباشرة من خلال المسألة الأولوية الدستورية. The French constitutional institution adopted the method of political control over the constitutionality of laws through the establishment of the constitutional council as independent political parties due to the lack of confidence in the judicial authority, and thus with the aim of protecting the basic rights and freedoms of individuals and ensuring respect for the principle of the constitution. The problem of this study revolves around the effectiveness of the mechanisms on which the Constitutional Council depends on the exercise of its oversight role in order to consecrate its political character? In order to deal with the issue in various aspects, the descriptive approach to this study was adopted in addition to the analytical approach in dealing with the legal texts and we concluded that the lack of previous political control exercised by the Constitutional Council according to the notification mechanism was the reason for activating subsequent judicial review of the constitutionality of laws, by recognizing the right of individuals to litigate in front the Constitutional Council indirectly through the Priority issue of constitutionality. Le consituant constitutionnel français a adopté la méthode du contrôle politique de la constitutionnalité des lois par la création d'un conseil constitutionnel en tant qu’organe politique indépendant en raison d’un manque de confiance dans le pouvoir judiciaire, afin de protéger les droits et libertés fondamentaux des personnes et de garantir le respect du principe de la suprématie de la constitution. La poroblématique de cette étude est l'éfficacité des mécanismes sur lesquels le conseil constitutionnel dépend de l'exercice de son rôle de contrôle afin de consacrer son caractère politique? Afin de traiter la question sous divers aspects se sont fié sur l’approche descriptive appropriée à cette étude, en plus de l’approche analytique dans le traitement des textes juridiques, nous avons conclu que l'absence de contrôle politique antérieure exercé par le conseil constitutionnel conformément au mécanisme de saisine a été motivée pour activer le contrôle judicaire a posteriori de la constitutionnalité des lois, en reconnaissant le droit des individus dans un litige devant le conseil constitutionnel, de manière indirecte par la question prioritaire de constitutionnalité.Item Open Access العنوان : مبدأ الفصل بين السلطات في ظل التعديل الدستوري في 2016 من خلال علاقة السلطة التنفيذية بالسلطة التشريعية(Université de M'sila, 2020-06) الطاوس, بن حموالملخص: إن مبدأ الفصل بين السلطات له مكانة مهمة عند الدستوريين و ذلك لاعتباره كمعيار لتصنيف الأنظمة السياسية في الدول، فهو المبدأ الذي يهدف إلى عدم تركيز السلطات في يد هيئة واحدة ، إلا ان النظام السياسي الجزائري ذو الطبيعة الخاصة يقوم على فكرة تقسيم السلطات و الوظائف في ظل وحدة القيادة و الواضح من خلال هيمنة و تدخل السلطة التنفيذية في مجال اختصاص السلطة التشريعية و كذا وسائل تأثير السلطة التنفيذية على السلطة التشريعية، و هي فكرة تتنافى و مبدأ الفصل بين السلطات الذي يقتضي استقلالية كل سلطة عن الأخرى مع وجود تعاون فيما بينها، و إن كان المؤسس الدستوري الجزائري لم يقر صراحة هذا المبدأ إلا في التعديل الدستوري الأخير في 2016. Authorizing the public utilities is considered as one of the main partnership strategies through which the state makes a contract with the private sector in managing, constructing and operating a public utility and exploiting it commercially for a sufficient period of time that enables it to give back the costs of this project and making gains and profits. Toutefois, le contrat exige de cette manière un cadre juridique et réglementaire protégeant l’État des dangers des investissements étrangers de longue durée, offrant à l’investisseur suffisamment de garanties lui permettant de protéger les privilèges du partenaire public et préservant le droit des utilisateurs de prendre des mesures de protection. les bénéfices des services d'utilité publique fournis avec l'autorisation des services publics.Item Open Access حل النزاعات الدولية بالطرق السلمية - المفاوضات أنموذجا- The Peaceful Resolution Of International Disputes – Negotiations Are A Model - Le Règlement Pacifique Des Conflits Internationaux - Les Négociations Sont Un Modèle -(Université de M'sila, 2020-06) محمد الصغير, سلينيملخص: ان العلاقات بين الدول ليست دائما مستقرة وهادئة، وتعارض مصالح هذه الدول يؤدي في كثير من الأحيان إلى قيام النزاع بينها، والحكمة تقضي في مثل هذه الحال بأن تسعى هذه الدول إلى تسوية النزاع وديا، وبأن لا تعمد إلى وسائل العنف إلا إذا دعتها الضرورة إلى ذلك. وقد اتجهت جهود الساسة محبي السلام منذ أواخر القرن الماضي إلى إحلال الوسائل السلمية محل القوة في فض النزاعات الدولية، وعقدت لهذا الغرض المؤتمرات الكبرى مثل مؤتمر لاهاي سنتي 1899 و1907، وفيهما تقررت مجموعة من الأحكام لتسوية النزاعات الدولية بالطرق السلمية، ثم أضيفت بعد ذلك إلى هذه الأحكام غيرها مما تقرر في عهد عصبة الأمم، وما أبرم تحت ظله من اتفاقيات، وبما تقرر أخيرا من ميثاق الأمم المتحدة. و يتم حل النزاعات الدولية بداية عن طريق الوسائل السلمية(الودية) وهي أول وسيلة تلجأ إليها الدول لتسوية خلافاتها، والوسائل غير الودية، أو طرق الإكراه، والتي قد تعمد إليها الدولة إذا ما أخفقت الوسائل الأولى، و تعتبر المفاوضات من بين اهم الوسائل أو الطرق الودية ، فما هو مفهوم المفاوضات وما هو دورها في حل النزاعات الدولية؟ Abstract: The relations between the countries are not always stable and calm, and opposing the interests of these countries often leads to conflicts between them, and the wisdom in such a case that they seek to settle the dispute amicably, and not to resort to hostility only if necessary. Since the end of the last century, the efforts of peace-loving politicians have tended to replace peaceful means instead of the force in settling the international disputes. For this purpose, major conferences such as the Hague Conference of 1899 and 1907 were held, in which a set of provisions for the peaceful settlement of international disputes was decided, and then added to these. The other provisions of the League of Nations, the agreements concluded under it and the Charter of the United Nations. Peaceful ways of settling the international disputes are two levels, amicable ways, the first thing that states have to resort to settle their differences, and unfriendly ways, or methods of coercion , that might be used by the state if the first means fail, and among Peaceful ways is the negotiations. So what is the concept of negotiations and what is Its role in resolving international conflicts? Résumé : Les relations entre les pays ne sont pas toujours stables et calmes, et les intérêts opposés peuvent entraîner souvent à des conflits entre ces pays . la sagesse exige dans ce cas, que chaque pays doit régler ces conflits amicalement et il ne doit pas revenir aux moyens de force sauf s'il est nécessaire. Depuis la fin du siècle dernier, les efforts des politiciens épris de paix , tendent à des moyens pacifiques au lieu de la force pour régler les disputes. Pour cela beaucoup de grandes conférences ont eu lieu comme celle de la Haye en 1899 et 1907, au cours desquelles un ensemble de dispositions pour le règlement pacifique des conflits internationaux a été décidé, puis ajouté à celles-ci, les autres dispositions de la Société des Nations, les accords conclus dans le cadre de celle-ci et finalement à la Charte des Nations Unies. Les moyens pacifiques pour le règlement des conflits internationaux sont en deux niveaux : les moyens amiables, la première chose à laquelle les États doivent recourir pour régler leurs conflits, et les moyens inamicaux, ou méthodes de coercition, auxquels l'État peut recourir si les premiers moyens échouent, et parmi ces moyens amiables, il y a les négociations. Quel est donc le concept de négociations et quel est son rôle dans la résolution des conflits internationaux ?Item Open Access دور إدارة الجمارك في حماية الملكية الفكرية(Université de M'sila, 2020-06) مبارك, بن الطيبيتتولى إدارة الجمارك بحكم موقعها الاستراتيجي تطبيق عديد القوانين والأنظمةعلاو على تطبيقا لقانون الجمارك، وعليه خصها المشرع بقمع مختلف الجرائم التي تقع على الحدود بما فيها جرائم الاعتداء على الملكية الفكرية، عن طريق مجموعة من التدابير الجمركية الخاصة. من خلال هذه الدراسة فإننا نسلط الضوء على مختلف أساليب وآليات تدخل إدارة الجمارك لموجهة كل أشكال التقليد والتعدي على حقوق الملكية الفكرية ودى فاعليتها، خصوصا تلك التدابير الإداري و الإجرائية أثناء المنازعات الجمركية المتعلقة بحقوق الملكية الفكرية.
