Abstract
تعتبر النقود الإلكترونية من بين أهم الابتكارات التي أفرزها التقدم التكنولوجي فقد أثارت بمختلف صورها عدداً من المسائل القانونية والتنظيمية التي يتعين الاهتمام بها تزامنا مع إصدار المشرع الجزائري للقانون 18-05 الخاص بالتجارة الإلكترونية الذي لم يتضمن أحكاما خاصة بها الأمر الذي يتطلب إيجاد نظام قانوني خاص بها، لذا تسعى الدراسة إلى توضيح بعض السياسات المتعلقة بالضوابط القانونية والتنظيمية الخاصة بتلك النقود، مع التركيز على تحديد الطبيعة القانونية الخاصة بإصدارها والتي لطالما أثارت جدلا فقهيا كبيرا مع التطرق لبعض الضوابط القانونية التي يتعين أخذها بعين الاعتبار عند وضع تشريع قانوني يخص النقود الإلكترونية. الكلمات المفتاحية:النقود الإلكترونية،التجارة الإلكترونية،دفع إلكتروني،تكنولوجيا المعلومات. Abstract: Electronic money is among the innovations created by technological advances so, it has raised in its various forms a number of legal and regulatory issues which should be taken care of ,coinciding with the promulgation by the Algerian legislator of the Law on Electronic Commerce 05-18 so, a legal system of its own had to be created , the study also seeks to clarify the most important issues raised by Electronic money with presenting some policies relating to the legal and regulatory controls of such moneys , with a focus on determining the legal nature of its promulgation which has long been raised a great juristic controversy with regard to legal controls, which should be taken into account when developing legal legislation for electronique money.
