| dc.description.abstract | مرت الجزائر ومنذ االستقالل بمجموعة من التشريعات وفقا لمدساتير المتعددة تعاقبت عمى تأطير االستثمار، والتي أظيرت عدة نقائص مما أدى إلى تػيير التوجو االقتصادي بصفة عامة واالستثماري بصفة خاصة تماشيا مع ما جاء في دستور نوفمبر 2020، وذلك بمراجعة األطر التشريعية و القانونية ومحاولة توفير بيئة استثمارية أكثر جاذبية الستقطاب المستثمرين األجانب، وتعد التشريعات و القوانين االستثمارية أداة الدولة لتشجيع االستثمار األجنبي المباشر، من خالل الضمانات القانونية والحوافز المالية التي تساىم في خمق المناخ المالئم لممستثمرين، وييدف بحثنا ىذا إلى تطرقنا لتكريس المشرع الجزائري لمبدأ حرية االستثمار، وعرض أىم الضمانات التي جاء بيا قانون االستثماررقم 18-22 . الكممات المفتاحية: اإلستثمار األجنبي المباشر، اآلليات التشريعية، ضمانات قانونية. Résumé Since independence, Algeria has passed a set of legislations in accordance with the various constitutions that successively regulated investment, which showed several shortcomings, which led to a change in the economic orientation in general and the investment orientation in particular, in line with what was stated in the November 2020 constitution, by reviewing the legislative and legal frameworks and trying to provide a more investment environment. Attractiveness to attract foreign investors, and investment legislation and laws are the state's tool to encourage foreign direct investment, through legal guarantees and financial incentives that contribute to creating a suitable climate for investors, and our research aims to discuss the dedication of the Algerian legislator to the principle of investment freedom, and to present the most important guarantees that the law Investment No. 22-18.
