| dc.description.abstract | إن إمتناع الإدارة الجبائية عن تنفيذ القرارات القضائية الإدارية الصادرة ضدها، لا يجسد مجرد الضرر الذي يرتبه هذا الامتناع في حق المكلف بالضريبة، الذي يكون في مواجهتها، بل يعد مساسا بهيبة القضاء الإداري، ويقضي على الآمال المعقودة عليه من جانب الأفراد، بوصفه الملاذ الآمن لهم من تعسف الإدارة، وتداركا لهذا الإشكال وضع المشرع الجزائري في القانون رقم: 08-09 المتضمن قانون الإجراءات المدنية والإدارية، بابا خاصا بتنفيذ أحكام الجهات القضائية الإدارية، في الباب السادس من المواد 977 إلى 987 منه، إضافة إلى قانون الإجراءات الجبائية الذي واكب قانون الإجراءات المدنية والإدارية في مسعاه، من خلال الوسائل التي يمكن اللجوء إليها في حالة عدم تنفيذ الإدارة الجبائية للأحكام القضائية الصادرة عن القاضي الإداري.
