Abstract
The cause of environmental pollution is primarily due to humans introducing foreign materials into it, and this pollution causes risks to human health that may extend for long periods of time. The issue of compensation for environmental damages in Algerian legislation also addresses the extent to which tort civil liability contributes to compensation for these damages as a result of the absence of provisions. There is a special legal framework that addresses this issue, contrary to what exists in European legislation.
The new approach to civil liability favors protecting the injured party over protecting the person responsible for the harmful act, and these new considerations are what forced the Algerian legislator to use the term act deserving of compensation instead of tort liability.
