dc.description.abstractملخص: إن فعالية حماية المستهلك الالكتروني من الشروط التعسفية التي يضعها المورّد الالكتروني،تقاس عبر ثلاث صور تكمّل بعضها بعضا، فأولى الصور هي تحديد المجال العام لحماية المستهلك الالكتروني ، عبر تعريف العقد الالكتروني و أيضا مجال تطبيق القانون من حيث أشخاص، من أجل الوصل إلى تقييم الفعالية الموجودة في ذلك التحديد، أما الصورة الثانية فهي الفعالية التي تستمد من ذاتية أحكام الشروط التعسفية، أما الصورة الثالثة ، و هي الفعالية التي تقاس بإجراء التكامل مع بعض آليات الحماية عبر الالتزام بالإعلام، الذي له دور مهم في تحقيق الفعالية المطلوبة، بشأن حماية المستهلك الالكتروني من الشروط التعسفية. Abstract: the effectiveness of electronic consumer protection from the abusive clauses established by the electronic furnisher, Measured across three images that complement each other, the first of images is the difinition of the public domain for the protection of the electronic consumer, by defining the electronic contract and also determining the area of application of the law in terms of persons, from in order to gain access to the effectiveness evaluation in that definition , the second picture is the effectiveness that derives from the subjective provisions of the abusive clauses, and the third, the effectiveness measured by the integration with some protection mechanisms through the obligation to the information, which has an important role in achieving effectiveness required, on consumer electronic protection from abusive clauses. Résumé: L’efficacité de la protection du consommateur électronique contre les clauses abusives établies par le fournisseur électronique, mesurée par trois images complémentaires, la première des images est la définition du domaine public pour la protection du consommateur électronique, en définissant le contrat électronique et aussi le domaine d’application de la loi en termes des personnes, afin d’atteindre Évaluer l’efficacité de cette sélection, la deuxième image est l’efficacité qui découle des dispositions subjectives des clauses abusives , et la troisième, l’efficacité mesurée par l’intégration avec certains mécanismes de protection par l’obligation de information , qui a un rôle important dans la réalisation de l’efficacité requise, sur Protection du consommateur électronique contre les clauses abusives.en_US
