Summary:
This publication encompasses the subjectlabeled "Inheritance and Donations," targetingthird-yearstudents of the Law and Sharia program within the framework of the core unit. It aims to simplify the complexities of thisfield and presentit to the studyingstudent in a straightforwardlanguage.
Typically, thisfieldbeginswith a historical introduction regardingitsorigins and major principlesacrossdifferent nations, peoples, religions, and laws, as inheritance has been a recognized aspect of humanitysinceantiquity. This isfollowed by an explanation of inheritanceamong the Arabs, with the advent of Islamiclegislationrelated to inheritance.
Subsequently, itdelvesinto the issues of thisfield, startingwithdefiningitslinguistic and legalrealities, itsrulings, merits, status, and literature. It then moves on to the most important topics, includinginheritance by default and by will, withdetailedexplanations of their conditions supported by problem-solving and examples. Thesetwotopicsconstitute the foundation of thisfield, and if the studyingstudentcomprehendsthemwell, they set themselves on the right path to graspthis science and understanditsremainingtopicseasily.
The science of inheritanceisknown to consist of two major parts: the theoretical aspect, whichinvolves the theoreticalprinciples of this science, and the practical-applied aspect, whichincludesproblems and examplesthatsolidify the understanding of the theoretical aspect. Therefore, increasing the number of representations and solvingproblemsaids in understanding the science and graspingitthoroughly.
Giventhat the specialization of the studentstargeted by this publication is Law and Sharia, itwasnecessary for Algerian familylaw and itsexplanations to beamong the primaryreferences for thissubject to understand the legal formulation adopted by the Algerian legislator for the vocabulary and provisions of this
هذه المطبوعة تشتمل على المقياس الموسوم ب"المواريث والتبرعات" والموجهة لطلبة السنة الثالثة ليسانس شريعة وقانون ضمن مقاييس الوحدة الأساسية عملت على تذليل مسائل هذا العلم وتقديمه للطالب الدارس بلغة سهلة بسيطة.
يبدأ عادة هذا العلم بمقدمة تاريخية حول نشأته وقواعده الكبرى عند مختلف الامم والشعوب والاديان والقوانين لأن هذاالعلم عرفته البشرية منذعرفت الوفاة، يتبع ذلك ببيان للميراث عند العرب حيث نزل التشريع الاسلامي المتعلق بالميراث.
ثم يشرع بعد ذلك في تناول مسائل هذا العلم حيث تفتتح ببيان حقيقته اللغوية والشرعية،وحكمه، وفضله، ومكانته، ومؤلفاته، لنتطرق بعد ذلك لأهم موضوعاته والمتمثلة في: الارث بالفرض، والارث بالتعصيب، مع شرحهما وتفصيل شروطهما مدعما ذلك بحل المسائل والامثلة، فهذين الموضوعين يعدان قاعدة هذا العلم ولبه ، وإذا ماستوعبهما الطالب الدارس جيدا يكون قد وضع نفسه على الطريق الصحيح لقهم هذا العلم والالمام بعد ذلك بسهولة بما بقي من موضوعاته.
يعرف علم الميراث بأنه يتكون من شقين كبيرين يتعلق الشق الأول بالجانب النظري ، حيث القواعد النظرية لهذا العلم، ويتعلق الشق الثاني بالجانب الحسابي التطبيقي حيث المسائل والامثلة التي ترسخ فهم الجانب النظري، وعلى هذا يعتبر الاكثار من التمثيل وحل المسائل أمرا مساعدا على فهم العلم والاحاطة به.
ولما كان يطلق على تخصص الطلبة الموجه لهم هذه المطبوعة ـالشريعة والقانونـ كان لزاما أن يكون قانون الاسرة الجزائري وشروحه من ضمن المراجع الاساسية لهذا المقياس لمعرفة الصياغة القانونية التي اعتمدها المشرع الجزائري لمفردات هذا العلم وأحكامه.
